RhettroScalia has accepted the fact that the justice system is not perfect, and innocent people will be convicted. “Like other human institutions, courts and juries are not perfect,” he wrote in a 2006 opinion. “One cannot have a system of criminal punishment without accepting the possibility that someone will be punished mistakenly.”
Would like to add that its very ironic how this judge who is for the death penalty (if i'm not mistaken) unintentionally gives one of the strongest arguments against the death penalty. Even the smallest chance of a totally innocent man being murdered by his own country should be enough to get rid of it.

Seems like you are taking it a little out of context. That quote to me says that he meant that innocent people do end up being wrongly convicted in any justice system and there's nothing that can be done. Which is true.
