This is up to interpretation. If you are aware and have reason to believe that he might actually stop if you contacted him, you're at least passively condoning what he's doing. Accessory is an exaggeration but I would assume it's at least in the same vain as denying assistance to someone you find on the streets bleading. I don't know much about common law though so actually, that might not even be illegal there.
Laws aside though, anyone involved should do what they can to get this ads arrested.
Also why isn't he arrested. What's up with the cops
