Video, positive rape kits, signs of violence against the victim, psychological evaluation, witnesses, etc. Most rape cases do not end in jail time. Often all you get is a restraining order. This is especially true when dealing with cases across country lines.

I think he's just being realistic, given the context of presenting this legally, we don't know how much evidence they actually have outside of their word.
Considering that Console already went down the legal road, though, I'm sure they have some if not ample evidence.
Without going into too much detail, the process he had to follow was demeaning and simply not worth the chance of justice. The state trooper he was speaking to described his chances of a successful case were about 6% regardless of validity of the evidence. Unless there's like actual video of the assault there's just not much a court can do. He has been through enough.
Oh, and hearing the process he was facing in order to press charges made me physically sick.

We push him out of the industry. A predator like him thrives in a position of power and his miserable ass won't have a position of power elsewhere. Obviously I would love to see jail time but that seems unreasonable given the bureaucracy involved. For now we be there for his victims and make potential future victims aware.
