reillyIt's not level dependent.
It's an item in your steam backpack, you just have to have it to select it. You can trade for them, buy them on steam market for like 30 cents, or get one from crafting a badge.

I was wondering how you get the background of your profile to look a certain way. I know that certain features come when you get to higher levels but my account is level 4 and my friends is level 3 even though he has the soldier as the background and I have a blank background. How would I get a TF2 character as the background?

After you record with lawena, as long as everything goes smoothly, a window should pop up that says registry editor or something like that after you exit TF2.(this is only if you aren't running lawena in administrator mode) if this didn't come up and you just exited, you may have quit lawena too soon before allowing it to restore all of your custom stuff and take out the lawena properties.

I have gone back to using the default minimal HUD and making the damage text large and green, the only thing I really don't like is the box that goes over everyone when you have your crosshair on them.
