Can someone explain to me if a religious institution can still discriminate against gay marriage? Marriage under law has a different meaning than marriage in the religious context. I believe this case is an issue of law and equal protection since the defendant was trying to sign his name as surviving spouse of a dead man (which has legal complications, not religious ones). This is just one step in the right direction, there is going to be backlash from religious groups who will see their institutions being harassed and a result will still be able to legally discriminate homosexuals.

I'm all for gay marraige, but forcing an institution to participate in something that's explicitly against their beliefs is fine. Besides that, gay couples will probably face discrimination (no matter how uncalled for it is) if they're married in a Christian/Catholic setting. And imposing punishment in the form of reduced funding is severely crippling, especially since churches run solely off of donations, fundraisers, and said government money.

Federal funding for churches set up a decade ago is only allowed because the money does not violate the Establishment Clause because it goes towards social services provided by churches and not actual church proselytization.
Churches can still marry or not marry whoever they want, that service is completely separate from the social services/community volunteering churches provide and the federal money that aids them in that.

They can already refuse to marry straight couples for any number of reasons. If they were in danger of legal action due to refusal to marry - and you're worried about this. First, go down to the court house with a consenting legal age adult, marry them, wait the requisite time so you can't annul the marriage, and then get a divorce. Now find a consenting legal catholic female and try to have a catholic wedding. You will find in most cases that they will refuse to do this without a *lot* of required stuff being done first, and even then they may refuse to do it on the grounds that they'll refuse to recognize your divorce. Or, on the other hand, find a conservative Islamic mosque, and attempt to marry a Muslim woman in their building without having first converted to Islam (and even then they may still refuse). All of these cases probably happen every day throughout America - they can refuse to marry for any number of reasons, it's their prerogative. Now a justice of the peace, or the courthouse, due to this SCOTUS ruling cannot refuse to issue you a marriage license however, that *would* be grounds for legal action.
